Terms and Conditions for Ignite Plumbing and Jet Blasting

These Terms and Conditions (the "Agreement") set out the legally binding terms and conditions under which Ignite Plumbing and Jet Blasting (“We,” “Us,” “Our”) will provide plumbing services to you (the “Client”). By engaging our services, you agree to comply with and be bound by these terms.

1. Provision of Services

Ignite Plumbing and Jet Blasting agrees to provide plumbing services as described in the quotation or service request. Services include, but are not limited to:

  • Residential and commercial plumbing work

  • Renovation and remodeling projects

  • Emergency repairs

  • New construction

  • Preventive maintenance

We will make all reasonable efforts to ensure the services are performed professionally and in accordance with Australian plumbing standards, specifically in compliance with the Plumbing Code of Australia (PCA) and any state-specific plumbing regulations.

2. Materials

We will supply materials as required for the completion of the agreed services. All materials provided by us will be of a suitable standard, compliant with relevant Australian regulations and standards, including AS/NZS 3500 and other applicable plumbing codes.

The Client will be informed of any changes in materials or costs and must approve these changes before proceeding.

3. Pricing and Payment Terms

Estimates and Quotes:
All quotations are based on the scope of work discussed during the initial assessment and are valid for 30 days. The total price may change if the scope of work changes or if additional materials or services are required. We will seek written approval from the Client before incurring any additional costs.

Payment Terms:
Payment is required upon completion of services unless otherwise agreed. For larger projects, a deposit of 10% may be required prior to commencing work. The balance is due upon satisfactory completion of the job.

We accept payments via credit card, cash, EFT, and late payments may attract interest at a rate of 10% per month, in accordance with Australian Consumer Law.

4. Consumer Guarantees

Under the Australian Consumer Law (ACL), our services come with guarantees that cannot be excluded. These guarantees apply to the quality of services and materials provided, ensuring they are fit for purpose and completed with due care and skill.

If there is a problem with the service or materials provided, the Client is entitled to request a remedy such as a repair, replacement, or refund in accordance with the Competition and Consumer Act 2010 (Cth).

5. Warranty

We offer a 3 years workmanship warranty on all services provided. Any defects or issues directly related to the work performed by Ignite Plumbing and Jet Blasting within this period will be rectified free of charge.

This warranty does not cover:

  • Issues caused by third-party interference or misuse.

  • Problems arising from materials supplied by the Client.

  • Normal wear and tear or pre-existing issues not related to our work.

6. Timing

We will make every effort to complete services within the agreed timeframe. However, we cannot be held liable for delays caused by factors beyond our control, including weather conditions, supply shortages, or third-party delays.

If a delay occurs, the Client will be notified immediately and provided with an updated schedule.

7. Limitation of Liability

To the fullest extent permitted by law, Ignite Plumbing and Jet Blasting will not be liable for any incidental, indirect, or consequential damages arising from the performance of services.

Our total liability for any claim relating to the service provided shall not exceed the total amount paid for the service in question. This does not affect any consumer rights available under the Australian Consumer Law.

8. Alterations and Additional Work

Any additional work or alterations to the original service agreement must be approved in writing by both parties and may result in additional charges and timeline adjustments. The Client will be provided with an updated estimate before proceeding with any changes.

9. Termination

Either party may terminate the service agreement if the other party is in breach of a material term of this Agreement, provided the breach is not remedied within 14 days of notice.

We reserve the right to terminate the Agreement if unsafe conditions arise or if the Client fails to make payments as agreed.

10. Health and Safety

Ignite Plumbing and Jet Blasting complies with all relevant Australian Work Health and Safety (WHS) laws and regulations, including the Work Health and Safety Act 2011 (Cth). The Client must ensure that the work site is safe for our employees and contractors. If hazardous conditions are identified, we reserve the right to suspend work until the conditions are rectified.

11. Confidentiality and Privacy

Both parties agree to keep confidential any information that is shared during the course of the services, unless disclosure is required by law. We comply with the Privacy Act 1988 (Cth) and will not share personal information with third parties without your consent.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of New South Wales, and any disputes arising will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Dispute Resolution:
In the event of a dispute, both parties agree to attempt mediation before pursuing legal action. The costs of mediation will be shared equally between the parties unless otherwise agreed.

13. Force Majeure

Ignite Plumbing and Jet Blasting is not liable for any failure or delay in performance due to circumstances beyond our control, including but not limited to acts of God, government restrictions, strikes, or supply chain disruptions.

14. Entire Agreement

This Agreement, including any associated quotes or service agreements, constitutes the entire understanding between the parties and supersedes all prior negotiations and understandings, whether written or oral.
